On 5 October 2026, the U.S. International Trade Commission published notice instituting preliminary antidumping and countervailing duty investigations on amine compounds from China. The case, Inv. Nos. 701-TA-808 and 731-TA-1809 (Preliminary), shows what an importer and supplier must manage after a petition but before any company cash-deposit rate exists.
Make three decisions first
Identify potentially affected merchandise and entries; ask U.S. trade counsel to verify the written scope, interested-party status and participation route; and put the official event, the actual filing deadline, the evidence owner and every gap in one case calendar. Record an unknown with an owner and next action. Do not enter zero.
1. What changed, and what did not
Evonik Corporation and Huntsman International LLC filed the petition on 29 September. The USITC has now opened the preliminary injury phase to decide whether there is a reasonable indication that the alleged Chinese imports materially injure, threaten material injury to, or materially retard the establishment of a U.S. industry.
The notice does not make an affirmative injury determination. It does not publish dumping margins, subsidy rates or cash-deposit instructions. The operational change is that participation and evidence deadlines are running.
2. Screen by code, decide by the written scope and merchandise
The notice lists HTS statistical reporting numbers 2909.11.00.00, 2921.29.00.55, 2922.19.96.90 and 2934.99.90.01. Use them to find records that need review. They do not replace the controlling written scope or the actual chemistry, use, form, production facts and entity chain. Obtain the petition and subsequent Commerce scope text before reaching a coverage view.
3. Turn the notice into an owned calendar
| Checkpoint | Notice | Control record |
|---|---|---|
| Entry of appearance and APO application | No later than seven days after publication | Have counsel confirm the computed deadline, holiday rules, status and filing path |
| Request to appear at the conference | By noon on 16 October | Participant, email, role and purpose |
| Conference testimony and supplementary material | By 4:00 p.m. on 19 October | Version, evidence source, confidentiality treatment and service |
| Staff conference | 9:30 a.m. on 20 October | Speaker, question owner and post-conference gaps |
| Written brief | By 5:15 p.m. on 23 October | Arguments, data, certificate of service and receipt |
| Preliminary determination target | By 13 November; views to Commerce by 20 November | Result monitoring and the trigger for the next cost and customer review |
4. Who supplies what
- Chinese producer or exporter: product chemistry, use, specifications, production facts, U.S. sales and the known customer chain.
- U.S. importer: importer identity, entries, customers and market records, plus the decision to obtain a participation assessment.
- U.S. trade counsel: scope, interested-party status, appearance, APO eligibility, filing route and actual deadlines.
- Output: one case calendar, one evidence index and an owner and next action for every unknown.
This pack cannot establish scope coverage, party status or APO eligibility. It cannot predict a rate, cash deposit or case outcome. Complete records allow review; they do not establish compliance or clearance.
5. Keep four procedural questions separate
| Stage | Question | Do not infer |
|---|---|---|
| Petition and USITC institution | Has the preliminary injury inquiry started? | Duties are already imposed |
| USITC preliminary determination | Is there a reasonable indication of injury so the case continues? | Final injury or a final rate |
| Commerce preliminary determination | What preliminary dumping or subsidy result and deposit treatment applies? | Final liability |
| Final determinations, orders and liquidation | What final result, order and entry treatment follows? | One result applies to every company and entry |
6. Build evidence in factual layers
Keep product records for chemistry, use, specifications and production; entity records for producer, exporter, invoice party and importer; transaction records for quotes, sales, invoices and entries; and market evidence only where the source and method can be explained. Mark the date, owner, source and public or confidential boundary on every item.
7. Facts, analysis and unknowns
Source facts: Federal Register document 2026-20286 provides the investigation numbers, petition date, HTS statistical numbers, participation rules, conference and brief dates, and the preliminary decision target. CZ Overseas analysis: importers and suppliers should manage merchandise facts, participation, evidence and timing in one case record. Unknown: without the actual merchandise, full petition scope, entry data and participant identity, this article cannot determine coverage or whether a company should enter the proceeding.
Primary sources: Federal Register 2026-20286 and the official govinfo PDF, checked 6 October 2026. Review again when USITC issues its preliminary determination, Commerce publishes scope or initiation material, or the Commission corrects the schedule.
Frequently asked questions
Does institution mean duties are already due?
No. This notice opens the preliminary injury phase and does not set a company rate or cash deposit.
Do the four HTS numbers settle coverage?
No. They are screening clues. Compare the actual goods with the controlling written scope.
Does a complete pack establish participation rights?
No. U.S. trade counsel should confirm status, APO eligibility, content and the actual deadline.
What this lets readers complete
Overseas importers can distinguish an investigation launch from a duty event and assign participation and evidence decisions before the deadline. Chinese suppliers can provide product and entity facts without presenting an allegation as a confirmed rate or outcome.
